Welcome to Pancakes & Booze! These Terms & Conditions (“Terms”) apply to your use of our website (pancakesandbooze.com), our online marketplace hosted on District.net, our social media pages, and participation in any in-person Pancakes & Booze events (collectively, the “Services”).

By using our Services, purchasing a ticket, signing up as an artist or vendor, submitting artwork, listing items on District.net, tagging us on social media, or attending our events, you agree to these Terms.

If you do not agree, please do not use our Services.

1. Who We Are

Pancakes & Booze is an underground art show and online marketplace platform. We bring together artists, vendors, and art lovers through in-person events and digital channels.

2. Eligibility

• Most U.S. events are 21+ (18+ in Canada), unless otherwise stated in event materials.

• Age restrictions vary by venue and city; check the specific event listing before purchasing a ticket or registering as an artist/vendor.

3. Artists & Vendors

By registering for an event or listing on our District.net marketplace, you agree to:

• Provide accurate information in your application.

• Manage your own sales at in-person events.

• Abide by any posted size, setup, and conduct rules.

• Understand that in-person sales are commission-free, but District.net sales include a 5% commission for Pancakes & Booze and 5% for District.net.

• Transport your artwork or products at your own risk; we are not responsible for loss, theft, or damage at any point.

4. Attendees

By attending a Pancakes & Booze event, you agree to follow venue rules and respect artists, vendors, staff, and other guests. Disruptive or unsafe behavior may result in removal without refund.

5. Intellectual Property & Media Rights

Our Rights:

All content, branding, logos, event names, graphics, designs, photographs, videos, and text on Pancakes & Booze platforms (including pancakesandbooze.com, our social media channels, and our event materials) are owned by or licensed to Pancakes & Booze. These are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or use them without our prior written consent.

Your Rights (Artists & Vendors):

You retain all rights, title, and copyright to your own artwork and content.
By submitting artwork to us, tagging us on social media, using hashtags related to our events, or listing your work on District.net, you grant Pancakes & Booze a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, display, distribute, and create derivative works from that content in any media for marketing, promotional, and commercial purposes.
This license applies to all public content related to Pancakes & Booze, including (but not limited to) hashtags such as: #pancakesandbooze, #pancakesbooze, #pnb, #p&B, #pb, #pancakesandboozeartshow, and any variations including city names before or after (e.g., #lapancakesandbooze, #pancakesandboozela).
While we make every effort to provide attribution, we cannot guarantee it in all cases, particularly for video content or when artist information is not available.

Attendees & General Public:

By attending a Pancakes & Booze event (as an artist, vendor, or guest), you consent to being photographed, filmed, or recorded. You grant Pancakes & Booze the same perpetual license described above for any images, video, or content in which you appear that is captured at our events or posted publicly online in connection with our events.

Third-Party Rights:

You represent and warrant that any artwork, content, or media you submit or post does not infringe the intellectual property rights of others. You are solely responsible for obtaining all necessary permissions for content you submit.

6. Photography & Video at Events

By attending any Pancakes & Booze event (as an artist, vendor, or attendee), you consent to being photographed, filmed, or recorded. These images and recordings may be used for promotional, marketing, and commercial purposes in any media without compensation.

7. Ticket Sales & Refund Policy

• All ticket, booth, and listing sales are final.

• Refunds may be granted at our sole discretion in special circumstances (e.g., event cancellation, major event changes, extreme hardship).

• No refunds will be issued for removal due to violation of these Terms.

8. Liability Disclaimer

• Pancakes & Booze is not responsible for any personal injury, loss, theft, or damage to personal property at events, including during transport to or from the event.

• We do not guarantee uninterrupted or error-free website operation.

• We are not liable for any issues caused by third-party services (including District.net).

9. District.net Marketplace

• Our online marketplace is hosted by District.net, which has its own Terms & Conditions and Privacy Policy.

• Any purchases, disputes, or technical issues on District.net are subject to their policies.

10. Privacy & Communications

By using our Services, you consent to our Privacy Policy and agree that we may contact you via email, text, or other communication methods you provide for marketing, transactional, or informational purposes.
